Hive5 acts as an intermediary in the sale of Claim Rights between investors and Loan Originators. If Hive5 became insolvent, the legal relationships under existing investments would continue to be governed by the applicable agreements. Hive5 would provide investors with information on transactions concluded through the platform, no new Investment Agreements would be concluded, and available funds would be returned as provided by the applicable agreements and law.
What happens if Hive5 becomes insolvent?
Insolvency of Hive5 shall not affect the legal relations between you (Investor), the Loan Originator and the Borrower as Hive5 acts only as an intermediary in the sale of the claim right between investors and loan originators.
In the case of insolvency of Hive5, the platform will provide investors with full information on transactions concluded within the platform. The conclusion of all new Investment Agreements on the platform would be stopped immediately. All funds available on the investor profile would be returned to the investors and the Loan originator unless not allowed by applicable laws.
